Mandatory eFiling Now Statewide in NY: What Law Firms Need to Know
Beginning July 7, 2025, the New York State Unified Court System will require eFiling in the Supreme Court – Civil Term statewide (excluding only Allegany and Erie Counties) including consumer credit, matrimonial, and foreclosure filings, expanding NYSCEF beyond its previous consensual limits. This is a significant procedural shift affecting all civil cases—including Article 70 and Article 78 proceedings, matrimonial, mental hygiene, election law, consumer credit, and residential foreclosures.
What’s Changing?
Under Article 21‑A of the CPLR and Uniform Rule 202.5‑bb, eFiling transitions from optional to compulsory for many previously consensual categories. All new civil cases must now be initiated and maintained through NYSCEF—unless a filer qualifies for an exemption:
Unrepresented parties are automatically exempt, but may opt in.
Attorneys may opt out if they demonstrate a lack of hardware, internet access, or technical capability.
