Method of Service
The plaintiff is responsible for serving papers, including the summons and complaint, to the defendant(s) named in the lawsuit. Luckily, New York City provides several methods of service, though the appropriate method will depend on the status of the defendant and case.
Nail and Mail
If all else fails, and there is no other option, the papers can be affixed to the door of the residence and mailed via first-class mail. Mailing must happen within 20 days of nailing documents to the door.
Proof of Service
By New York City law, you must have proof the service of process was completed lawfully. With Proof, you’ll have geo-tagged photos of a successful serve along with an affidavit detailing who completed the service, the papers served, the person who was served, and evidence that the service was performed as authorized.
Personal Service
The most common method is personal service, where the documents are delivered by hand within the state. New York City requires the one serving papers to be 18 years or older, and those serving more than 5 times a year require a license from the DCWP. Proof only works with process servers with 2 years of experience in NYC and a DCWP license.
Substituted Service
If the papers can’t be personally served within the state, the summons can be delivered to another adult at their residence or business. However, if this method is used, it must also be mailed via first-class mail to the same address. When delivered to a business, the envelope must not indicate that it’s from an attorney or law office, and it must be marked “personal and confidential.” Delivering to a designated agent that the defendant has agreed upon is possible, but not for divorce cases.
