New Jersey Service of Process Rules

NJ Methods of Service

New Jersey allows for several methods of service including:

  • Personal service: When someone who is not a party to the case hand-delivers documents to the other side

  • Service by mail: When someone who is not a party to the case mails documents to the other side

  • Substituted service: After 3 or more failed attempts to serve the papers, the process server can then leave the papers with someone else at the party’s residence

Who to Serve and Where

Who you’ll serve will depend on the specifics of your particular case. If you’re suing an individual, then you’ll want to serve them at their place of residence or work. However, if you’re suing a corporation, business, or other entity, who you’ll want to serve will vary and your Proof server will take that into account.

Process Server Rules in New Jersey

New Jersey process servers can serve any day of the week including Sundays and allows private process servers to serve papers. Servers do not need to be registered or licensed in any way. Methods like “nail and mail” are not allowed in New Jersey.
