What You Need to Know About Texas’ Updated Affidavit Requirements

Effective December 1, 2024, the Texas Supreme Court’s amendments to Rules 103, 107, and 501 bring significant updates to service of process and affidavit requirements.
Proof is already ahead of the curve, with updated affidavit language that ensures full compliance—helping you confidently keep your cases moving forward. Below is a summary of the changes.
What’s Changing?
Here’s a breakdown of the key updates:
Rule 103 (Who May Serve): Process servers in Texas must now be certified by the Judicial Branch Certification Commission (JBCC).
Proof Impact: No action required. Proof already mandates JBCC certification for all Texas servers.
Rules 107 & 501 (Return of Service): Affidavits of service must state that servers are at least 18 years old, replacing the previous requirement to include their date of birth.
Proof Impact: Our affidavits already reflect the new language to ensure compliance.
